ContentMX Privacy Policy

ContentMX, LLC (“ContentMX,” or “we”, “our”) will always respect and protect the privacy of our customers and those who use our website, web and mobile applications (our Platform). The following Privacy Statement provides details about how personal information is collected and used. This privacy statement applies to all of our website, products and services.

This notice applies to our Platform located at https://www.contentmx.com, https://www.butterflypublisher.com, https://*.lll-ll.com, https://channelmarketingjournal.com, other private label URLs or any successor website thereto. By using our Platform you are accepting the practices described in this Privacy Notice.

Types of Users

This Privacy Policy applies to different kinds of Users of our Platform whose roles are determined by the way they are related to ContentMX and its customers, and the types of activities they conduct.  

Licensed User

You hold an account with a username and password that is used to gain access to certain features of our Platform such as our communication tools and services. Access may be provided through your direct relationship with ContentMX or as the result of a relationship with one of our partners.

Internet User

You receive communications (email, social media posts, or blog posts) from Licensed Users and visit hosted landing pages on our Platform where you may also interact with web forms that capture leads or for sharing content.

Website Visitor

You are visiting our website to obtain marketing, support or training information.

How We Collect Personal Information

Our Platform offers many places where information can be collected, displayed, and shared. This information is secured behind a user login and additional security measures. The data we collect is used for sending and retrieving information between individuals and other 3rd party services. When you “publish” information from our servers, this information will be made available to anyone who can access this information on the Internet. When we collect information from 3rd party services (like Google, Facebook, or Microsoft), this information will be held privately within your account and may be “published” by you to other 3rd party services. Personally identifiable data such as names and email addresses are not able to be “published”, and will be kept privately in only your account unless you choose to export this data to your own computer.

Our Platform offers several opportunities for visitors to register. These registration forms enable users to opt-in to mailing lists managed by us or Licensed Users and require users to give contact information (such as first name, last name and email address). We use this contact information to send information about our company and our products and services. Licensed Users use this contact information to send information about their company and services. Notice is given at the point of collection to enable users to choose whether or not they consent to the usage terms. Those who have signed up and subsequently wish to withdraw their participation may opt-out of receiving future mailings at any time (see the choice/opt-out section below).

What We Collect

We gather personal information when you register for ContentMX and become a Licensed User. During registration, ContentMX will ask for some or all of the following information: your name, company name, title, mailing address, city, state, postal code, email address, telephone, country, username, password, and your permission to contact you with relevant updates about our products and services.

After you register you are no longer anonymous to ContentMX and are given a ContentMX Username that allows you to take full advantage of the Platform. We store information that we collect through the Internet or by telephone, and log files to create a profile of our Users. A profile is stored information that we keep on individual Licensed Users, Internet Users and Website Visitors that details their viewing and selection of content and services preferences. Consequently, collected information is tied to the user’s personally identifiable information to provide relevant content and improve the content of our Platform for the user. This profile is used to tailor a user’s visit to our Platform, and to direct pertinent content to them. User’s can opt-out of the receipt of marketing materials or close and delete their account at any time.

We gather personal information when an Internet User or Website Visitor fills out a lead capture form or sharing form. These forms will collect information such as: your name, address, city, state, postal code, email address, telephone, country, company name, title, and your permission to contact you by email in the future.

We do not share the personally identifiable profile information of Website Visitors with other third parties. Your profile information is shared in aggregated, unidentifiable form only.

We use log files to collect internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer our Platform, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. Log files are not linked to personally identifiable information in our database, except as entered by the user during registration.

In addition, we might ask you for personal information if you report a problem with one of our sites or services. If you contact ContentMX or if we contact you, we might keep a record of that correspondence. ContentMX also occasionally asks users to complete surveys that we use for research purposes. Wherever ContentMX collects personal information we make an effort to include a link to this Privacy Notice.

Please note that our Platform links to other Internet sites. Any information that you post to or otherwise provide to any such Internet site may not be protected. Additionally, Internet sites other than our Web site may collect your information without your knowledge. ContentMX does not control any Internet site other than our Web site and thus is not responsible for the privacy practices, privacy statements, or content of these other Internet sites.

Information from Children

ContentMX is not for use by children under the age of 18. No child under the age of 18 is permitted to register with ContentMX. ContentMX will not knowingly collect personally identifiable information from anyone under the age of 18.

Information Collection and Use by Our Customers

You may be asked to provide certain personal information to our Licensed Users (our customers) in connection with their use of our products and services, such as when you fill out a form or share information. If you choose to provide personal information to one of our customers, you should review the individual privacy policy of that customer. We are not responsible for the privacy practices of our customers.

Security and Privacy

We take every precaution to protect the confidentiality and security of your personal information by using industry-recognized security safeguards such as firewalls, coupled with security procedures to protect your information from loss, misuse or unauthorized alteration. When we collect sensitive account information such as passwords and credit card numbers, we protect its transmission through the use of encryption such as the Secure Socket Layer (SSL) protocol.

We recommend that you do not divulge your password to anyone. ContentMX will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also remember to sign out of your ContentMX account and close your browser window when you have finished accessing our Platform. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place such as a library or Internet cafe.

While no data transmission over the Internet can be guaranteed to be 100% secure, we strive to protect your personal information.

ContentMX takes care to reinforce the importance of our Users security and privacy among our employees. Our employees are trained and required to safeguard your information and, using physical, electronic and procedural safeguards, we restrict access to personal information to those employees and agents for business purposes only. Additionally, we regularly review the adequacy of our security procedures.

We will never share, sell, or rent your personal information with third parties for their promotional use. Occasionally, we enter into contracts with third parties so that they can assist us in servicing you (for example, providing email delivery and customer service). The contracts prohibit them from using any of your personal information for their own purposes, and they are required to maintain the confidentiality of the information we provide to them. We may also disclose certain information to partners who introduced you to our services. Lastly, we may disclose or report personal information in limited circumstances where we believe in good faith that disclosure is required under the law. For example, we may be required to disclose personal information to cooperate with regulators or law enforcement authorities, to comply with a legal process such as court order, subpoena, search warrant, or law enforcement request.

Protecting Information

For Licensed Users, ContentMX does not access your Contact Lists, contact people on your lists, market to people on your lists, sell your lists, or share your lists with any other party (including the partners syndicating marketing materials through ContentMX), except as required by law or in response to a complaint directly from an individual on one of your lists. Only selected, authorized personnel have access to view Contact Lists. You may export (and download) your lists from ContentMX at any time.

We will use and disclose the information in your Contact Lists only for one or more of the following purposes:

  1. To help enforce compliance with our Terms of Use and applicable law.
  2. To protect the rights and safety of our employees, owners, and officers.
  3. To meet legal requirements such as complying with court orders and valid subpoenas.
  4. To prosecute and defend a court, arbitration or similar proceeding.
  5. To transfer your information in the event of the sale of all, or substantially all, of the assets of our business to a third-party or in the event of a merger, consolidation or acquisition. However, in such event, any acquirer will be subject to our obligations under this Privacy Policy.
  6. To provide information received hereunder to representatives and advisors such as attorneys and accountants to help us comply with legal and other requirements.
  7. To provide customer support.

Use of Cookies

A cookie is a small amount of data that is sent to your computer through your Internet browser to enable our systems to recognize your browser and to provide special features and maintain a session on our servers. All areas on ContentMX where you are prompted to log in or that are customizable require that you accept cookies. In all cases in which cookies are used, the cookie will not store personally identifiable information except with your explicit permission.

We use cookies to tell us who you are and to access your account information (stored on our servers) in order to deliver to you a a personalized service. This cookie is set when you register or ‘sign in’ and is modified when you ‘sign out’ of our services. We also use cookies to assist ContentMX Licensed Users to track visits to content.

Use of Personal Information

ContentMX uses personal information (i) to identify you on our system, (ii) for general contact information (i.e. to communicate with you), (iii) for statistical purposes and (iv) as otherwise reasonably required in order to conduct business with you or to provide products or services to you.

ContentMX also does research on our users behaviors based on the information provided to us during registration, from our server log files and user profiles or from surveys. We do this to better understand and serve our users. This research is compiled and analyzed on an aggregated basis. ContentMX may share this aggregated data with business partners. This information is not linked to any personal information that can identify any individual person.

Sharing of Information with Partners

When you are on the ContentMX Platform and are asked for personal information, you are sharing that information only with ContentMX, unless it specifically states otherwise. Some ContentMX products or services are offered in conjunction with a partner company. In order to provide this co-branded product or service to you, it is necessary for us to share your personal information with our partner company. If data is being collected and/or maintained by any company other than ContentMX, you will be notified prior to the time of the data collection or transfer. These partners are not allowed to access your personally identifiable information (e.g., first name, last name, company name and email address) except for the purpose of providing those products or services. If you do not want your data to be shared, you can choose not to allow the transfer by not using that particular service.

Collection and Use of Information from Partners

It is possible to connect your account on the ContentMX Platform with 3rd party providers like Google, Microsoft, Facebook, Twitter etc. When these connections are made, ContentMX accesses, uses, stores, and shares information from these providers on a limited basis, only in accordance with the use of data as stated in this privacy policy and only for the purpose as initiated through use of the ContentMX platform. This includes the limited use of contact information (names and email addresses) and the ability to send email messages to these contacts, on an opt-in basis, according to applicable laws. This information is not shared with any other partner or provider.

Choice / Opt-Out

You have a choice about how we use your personal information to communicate with you, and you may opt out at any time by unsubscribing or changing your preferences.

Our Anti-Spam Policy allows for only permission-based email. You always have the opportunity to opt-out of our marketing communications with you or change preferences by following a link in the footer of all non-transactional email messages sent by us or by emailing us at privacy@contentmx.com. In addition, anyone receiving emails from us on behalf of our Licensed Users always has the opportunity to opt-out of email messages from such User by using the opt-out link included in the link in the footer of the message. If you believe that you have received an unsolicited commercial email from us on behalf of any of our Licensed Users, please report it to us immediately at abuse@contentmx.com.

Some communications (for example, weekly digest mailings, important account notifications and billing information) are considered transactional and are necessary for all of our Licensed Users. In some cases, you will be able to opt-out individually from weekly digest notifications by following the link in the email footer. However, to opt-out of all communications you must cancel your ContentMX account. To cancel your ContentMX account, please email support@contentmx.com. You may still receive marketing communications from us even after you cancel your account unless you also opt-out of our marketing communications, as described above.

To manage the information we receive about you from a social networking site or any other third party, you will need to follow the instructions from that party for updating your information and changing your privacy settings. The information we collect is covered by this privacy statement and the information the third party collects is subject to such third party’s privacy practices. Privacy choices you have made on any third party site will not apply to our use of the information we have collected directly through our Platform.

ContentMX does not sell or rent your personally identifiable information to anyone. Except in the event we sell or transfer your information as part of the sale or other transfer of all or substantially all of our assets or all or substantially all of a division, section or other distinct portion of our business, we will notify you at the time of data collection or transfer if your data will be shared with a third party, and you will always have the option of not permitting the transfer.

Correcting or Deleting Personally Identifiable Information

You may edit your ContentMX account information at any time by signing in to your ContentMX Account with your username and password. To permanently delete your personally identifiable information and close your account, you can email support@contentmx.com.

Access to Personal Information

We take steps to ensure that the personal information we collect is accurate and up to date, and that you have the ability to access it and make corrections to it.

Upon request ContentMX will provide you with information about whether we hold, or process on behalf of a third party, any of your personal information. To request this information please contact us at privacy@contentmx.com or use this form.

Licensed Users can review and update their ContentMX account information, including company name and email address, by logging in to their ContentMX account. Account information, such as your username and password, can be changed by logging in and then clicking on the My Account link from the Settings menu. If you would like to suspend or cancel your account, request that we no longer use your account data or obtain further information about or access to your personal information, you can do so by contacting support@contentmx.com

We will retain and use your information for as long as your account is active or as needed to provide you with services, as necessary to comply with our obligations under this privacy statement and at law, resolve disputes, enforce our agreements and for backup purposes.

International Use

We are headquartered in the United States of America. Personal information may be accessed by us or transferred to us in the United States or to our affiliates, partners, or service providers elsewhere in the world. By providing us with personal information, you consent to this transfer. We will protect the privacy and security of personal information according to this privacy statement, regardless of where it is processed or stored, however you acknowledge and consent to the fact that personal information stored or processed in the United States will be subject to the laws of the United States, including the ability of governments, courts or law enforcement or regulatory agencies of the United States to obtain disclosure of your personal information.

For the purposes of European Directive 95/46/EC and applicable national implementing laws in your jurisdiction, with respect to your data, we are a data controller and with respect to your contacts’ information, we are a data processor.

Accountability and Compliance with Privacy Shield

ContentMX participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (together, the “Frameworks”). ContentMX is committed to subjecting all personal data received from European Union (“EU”) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework to the Framework’s applicable principles. The policies and rights outlined below are therefore equally and explicitly applicable to Users from Switzerland, except if stated otherwise. ContentMX has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.

What does this mean for the European or Swiss User?

ContentMX is responsible for all processing of Personal Data it receives under the Privacy Shield Framework from European Union or Swiss individuals and commits to subject the processed Personal Data to the Privacy Shield Principles. This, most importantly, includes the right of individuals to access their personal data processed by ContentMX. To exercise your Data Subject Access Rights, you can fill out this form.

ContentMX also complies with the Privacy Shield Principles for all onward transfers of Personal Data from the EU and/or Switzerland, which means that it remains liable in cases of onward transfers to third parties.

With respect to Personal Data received or transferred pursuant to the Privacy Shield Framework, ContentMX is subject to the investigatory and regulatory enforcement powers of the FTC, if not stated otherwise in this privacy policy.

ContentMX is further required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Dispute resolution under the Privacy Shield

In compliance with the Privacy Shield Principles, ContentMX commits to resolve complaints about its collection or use of the User’s Personal Data. European Union or Swiss individuals with inquiries or complaints regarding this Privacy Shield policy should first contact ContentMX at privacy@contentmx.com or write us:

In case of failure by ContentMX to provide a satisfactory or timely response (within 45 days), the User has the option of involving an independent dispute resolution body, free of charge.

In this regard, ContentMX has agreed to cooperate with the panel established by the EU data protection authorities (DPAs) and comply with the advice given by the panel with regard to data transferred from the EU. Similarly, ContentMX is committed to advice given by the Swiss Federal Data Protection and Information Commissioner in regard to data transferred from Switzerland. The User may therefore contact ContentMX at the email address provided at the beginning of this document in order to be directed to the relevant DPA or Commissioner contact.

Under certain conditions – available for the User in full on the Privacy Shield website (https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint) – the User may invoke binding arbitration when other dispute resolution procedures have been exhausted.

Notification of Changes

We reserve the right to modify this privacy statement at any time, so please review it frequently. If we decide to change this privacy statement in any material way, we will notify you here, by email, or by means of a notice on www.contentmx.com so our users are always aware of what information we collect, how we use it and under what circumstances we disclose it. For material changes in how we use personal information, we will provide advance notice by email (sent to the email address specified in your account) or by means of notice on our website prior to the change becoming effective. In all cases, your continued use of our products and services constitutes consideration and your binding acceptance to any such changes.
